Question: Will you comment please on the decision of the National Assembly of the Republika Srpska, one of two federated entities, to hold a referendum on confidence in the justice system in Bosnia and Herzegovina?
Alexander Bikantov: Moscow is closely monitoring the reaction of our international partners in the Bosnian settlement and the reaction of the Balkans to the July 15 decision of the National Assembly of the Republika Srpska on confidence in the justice system in BiH.
Both the Bosnian political forces and the international community agree that the justice system in Bosnia and Herzegovina is ineffective. There is a bias against Bosnian Serbs, one of the federation’s main ethnic groups. Infringement of their legitimate rights does not evoke proper reaction from the national bodies of justice. This is why the Republika Srpska had to resort to available democratic instruments to ensure the implementation of its legitimate interests.
I would like to remind you that the idea of a referendum was raised several years ago. Efforts were taken to return the situation to the level of talks, which, however, proved ineffective, but not through the fault of the Republika Srpska.
However, we still believe that the BiH problems, including ethnicity-based distortions in the bodies of justice and the need to correct them, would be better tackled through an equal and more effective dialogue based on mutual respect between all members of the internal political process, in compliance with the Dayton Peace Accords. Refusal to hold substantial discussions with the Republika Srpska, or worse still, partisan interference by the High Representative for Bosnia and Herzegovina would only further destabilise Bosnia and Herzegovina.
